Is Trial Experience Necessary for My Personal Injury Case?

A large percentage of personal injury cases, roughly 95% are settled outside of court. The reason for this is because after all investigations are complete, both attorneys will usually arrive at a similar estimation as to the value of a case. It's more cost-effective for both sides to negotiate a settlement outside of court than it is to go to a jury trial where the outcome is unpredictable.

When both sides arrive at a similar ballpark figure, they will usually go back and forth until a fair settlement is reached. However, when there is a large discrepancy in the value of the case; for instance, your attorney thinks your case is worth several million, but the other side is only offering you $150,000, then your case very well may go to trial.

Even though the vast majority of cases are settled in negotiations outside of court, there are going to be those cases where the respective attorneys do not meet eye-to-eye on a settlement figure. If your case is one of those cases where your attorney thinks it's worth far more than what the defendant's attorney is offering, then you're going to want to hire a lawyer who has extensive trial experience under his or her belt.

When it comes to a jury of complete strangers, there is no telling beforehand what they are going to think of the evidence or how much of a verdict they are going to award. Because of the unpredictability of a jury trial, the outcome of your case is going to rely heavily on your attorney's ability to both present strong and compelling evidence, and on his or her ability to speak persuasively and convincingly. Such trial skills are only acquired through years of experience arguing before juries.
