West Virginia Case Law

In 2011, there were three wrongful death cases filed against West Virginia nursing homes, with Brown vs. Genesis Healthcare Corp. being against the Marmet Center.

All the cases someone was admitted to a nursing home, and a family member signed an admission agreement that contained an arbitration clause.

After the resident died, the victims' families filed wrongful death suits against the nursing home, alleging that the nursing home was responsible for the resident's death.

The nursing home attempted to get the lawsuit dismissed and compel the surviving family members to participate in binding arbitration.

The Supreme Court consolidated the three cases and held that arbitration clauses are unenforceable to compel arbitration in disputes concerning a personal injury or wrongful death.

Lawyers Applaud Supreme Court Ruling

Trial lawyers statewide commended the West Virginia Supreme Court of Appeals for its decision in cases stating that arbitration agreements in nursing home contracts were "unconscionable and unenforceable."

In the above ruling, the court said that while arbitration was an expeditious way to resolve disputes, it was also a way for nursing homes to resolve Federal Arbitration Act violations away from the public's eye.
